Fatal New York City Hit-and-Run Car Accident

A 39-year-old pedestrian was killed in a New York car accident after she was struck by a vehicle at the intersection of Broadway and 90th Street. According to a CBS News report, the woman was walking in a marked crosswalk when she was hit by a 2010 Ford. The vehicle sped away after striking the woman. The critically injured pedestrian was transported to a local hospital where she was pronounced dead. Police arrested a 25-year-old man who they said was the hit-and-run driver in the Ford.

Hit-and-run or leaving the scene of an accident is a serious crime in New York State. If you are a motorist involved in an accident, you are required under the law to stop, provide information and render aid to the injured victim, if it is possible to do so safely. Leaving a seriously injured victim can result in a felony charge for the hit-and-run driver. Motorists are also required to stop for a pedestrian who is walking legally in a marked crosswalk.

Under New York Penal Law section 1151: "The driver of a vehicle shall yield the right of way, slowing down or stopping if need be to so yield, to a pedestrian crossing the roadway within a crosswalk when the pedestrian is upon the half of the roadway upon which the vehicle is traveling or when the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger, except that any pedestrian crossing a roadway at a point where a pedestrian tunnel or overpass has been provided shall yield the right of way to all vehicles."
